Agreement to Terms

By downloading, accessing, or using PokeVest, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the app.

Geographic Restrictions

PokeVest is currently intended for users located in the United States, Canada, and Mexico.

We do not guarantee that the service is appropriate for or compliant with laws outside these jurisdictions. If you access the app from outside the United States, Canada, or Mexico, you do so at your own risk and are responsible for complying with local laws.

Who Can Use PokeVest

You must be at least 13 years old to use the app. If you're under 18, you must have a parent or guardian's permission.

If you are under 18, you may not purchase a subscription without consent from a parent or guardian. Subscription purchases made without proper authorization are subject to the applicable platform's billing, family controls, and refund processes, as well as applicable law.

What PokeVest Does

PokeVest helps you:

• Track your Pokémon™ TCG collection and portfolio
• Organize and visualize your collection and portfolio over time
• Monitor card prices and trends

PokeVest does not offer financial or investment advice. It's a tool to help you organize and view information only.

User Accounts & Security

If you create an account, you're responsible for keeping your login information safe. Don't share your credentials. Let us know right away if you believe your account has been accessed without your permission.

Your Data

You own the content you add (like card photos or notes). By using the app, you give us permission to store, process, and use your content to operate and improve the app.

Please read our Privacy Policy to learn how we collect, use, and protect your data.

Feedback and Suggestions

We welcome your ideas! If you send us suggestions or feedback, you agree we can use them without restriction or compensation. Please send us your feedback to feedback@southernislands.llc.

Acceptable Use

You agree not to:

• Use the app for anything illegal or harmful
• Reverse-engineer, decompile, or tamper with the app
• Copy or resell any part of the app or its data
• Scrape, harvest, or otherwise extract data from the app or its back-end services using automated tools (including bots, scripts, or crawlers)
• Upload anything offensive, harmful, or infringing
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious code or viruses
• Violate any laws or regulations
• Infringe on intellectual property rights

License to Use the App

We give you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, or attempt to access the app's source code.

App Store Terms

If you download PokeVest through the Apple App Store, you acknowledge that these Terms are between you and Southern Islands Trading Card Company LLC, not Apple, and that Apple is not responsible for the app or its content. To the extent required by applicable platform terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you download PokeVest through Google Play, you acknowledge that Google is not responsible for providing support or maintenance for the app except as required under applicable platform terms.

Intellectual Property

All content in the app — including our name, logo, design, and original content — belongs to PokeVest or its licensors. You may not use our branding or content without permission.

Pokémon™ cards, characters, and related materials are trademarks of The Pokémon™ Company. We are not affiliated with The Pokémon™ Company.

Third-Party Content and Services

PokeVest may display information from third-party sources (like market prices or card databases). We don't control or guarantee the accuracy of this data and aren't responsible for their content or services.

Pricing Information

Price data and trends are provided for informational purposes only. We try our best to provide accurate and up-to-date info, but we do not guarantee:

• Accuracy of pricing data
• Real-time price updates
• Actual market values
• Investment advice or recommendations

Users should conduct their own research before making purchasing decisions.

This disclaimer applies to all data and analytics provided by PokeVest, including but not limited to: portfolio valuations, market insights, peer percentiles, portfolio benchmarking, price alerts, and price history charts. These features are tools for informational purposes only. PokeVest does not guarantee the accuracy, timeliness, or completeness of any analytical data. Price alerts are sent on a best-effort basis and may be delayed or missed due to data availability, processing times, or technical issues. You should not rely solely on PokeVest alerts or analytics for buying or selling decisions.

Premium Subscription

PokeVest offers an optional paid subscription ("PokeVest Premium") that unlocks additional features. Premium is not required to use the core app — free features remain available. Premium features and limits may change over time; current benefits are listed in the app and on the website.

PokeVest may occasionally grant complimentary or promotional premium access at its sole discretion. Promotional access may be revoked at any time and does not create an ongoing entitlement to premium features. Promotional subscriptions are not transferable and may have different terms, durations, or feature sets than paid subscriptions.

Billing and Payments

Subscriptions are billed through Apple App Store or Google Play Store depending on your device. Payment is processed by the respective platform — PokeVest does not directly collect or store payment card details.

• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date
• Pricing is displayed in the app before purchase and may vary by region or platform
• PokeVest reserves the right to change subscription pricing with reasonable advance notice; price changes take effect at the next renewal, not mid-cycle

Payment is charged to your Apple ID or Google Play account at the time of purchase confirmation. Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period at the same rate. You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.

Billing Issues and Grace Periods

If your subscription payment fails (for example, due to an expired credit card or insufficient funds), you may receive a brief grace period during which premium features remain accessible. This grace period is managed by your payment platform (Apple or Google) and is not guaranteed. If the billing issue is not resolved within the grace period, your premium access will be suspended and your subscription may expire. It is your responsibility to keep your payment method current with Apple or Google. PokeVest is not responsible for service interruptions caused by failed payments.

Cancellation and Refunds

You may cancel your subscription at any time:

• Apple: iOS Settings > [your name] > Subscriptions
• Google: Google Play > Payments & subscriptions > Subscriptions

Cancellation takes effect at the end of the current billing period — premium access continues until then. Partial refunds are generally not provided for unused portions of a billing period, except where required by applicable law or platform policies.

PokeVest does not process subscription payments directly. Subscription charges, refunds, billing disputes, and cancellation management are handled by Apple or Google under their respective platform terms and policies. If you believe you are entitled to a refund, you should contact Apple or Google directly through their support channels.

Subscription Transfers

Your subscription is tied to your Apple ID or Google account, not your PokeVest account. If you restore a subscription on a different PokeVest account, the subscription will transfer to the new account and the previous account will lose premium access. Only one PokeVest account may hold a given subscription at any time. PokeVest is not responsible for premium access lost due to subscription transfers between accounts.

Free vs Premium Features

Certain features and usage limits differ between free and premium users. PokeVest may add, remove, or modify features in any tier at any time. For changes that materially reduce premium functionality, we will provide at least 14 days' notice via the app or email. Changes to features generally do not entitle you to a refund for any remaining subscription period, except where required by applicable law or platform policy. By continuing to use the service after a feature change, you accept the updated feature set.

Downgrading to the free tier (via cancellation or expiry) does not delete any user data. However, if your usage exceeds free-tier limits (for example, multiple portfolios or watchlist items beyond the free limit), you will retain your existing data but may be unable to add new items or access certain features until you reduce usage to within free-tier limits or resubscribe.

Changes to the App

We're always working to improve PokeVest. That means we may add, remove, or change features at any time, including changes to premium features, subscription tiers, and pricing. We can't guarantee the app will always be available or error-free.

Right to Refuse Service

We reserve the right to suspend or terminate accounts or restrict access to the app where reasonably necessary to protect the service, users, or our business. This may include cases involving suspected fraud, abuse of the service, violations of these Terms, security concerns, legal compliance requirements, or nonpayment of applicable fees.

Termination

You can stop using the app at any time. We may suspend or delete your account if you violate these Terms, misuse the app, or if we discontinue the service.

Deleting your PokeVest account does not automatically cancel your subscription. You must cancel your subscription through your device's subscription settings (Apple or Google) before or after deleting your account. If you delete your account without cancelling your subscription, you will continue to be charged by Apple or Google until you cancel. PokeVest is not responsible for charges incurred after account deletion.

Indemnification

You agree to indemnify, defend, and hold harmless Southern Islands Trading Card Company LLC and its owners, employees, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the app
• Your violation of these Terms
• Your violation of any law or regulation
• Any content you upload, including card images, notes, or other materials

Limitation of Liability

To the fullest extent allowed by law, PokeVest and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or other intangible losses, resulting from:

• Your use of or inability to use the app
• Errors, bugs, or delays in the app
• Any data loss or corruption, except where caused by our gross negligence or willful misconduct
• Unauthorized access to your account or data
• Third-party services or content accessed through the app

In any case, our total liability won't exceed the amount you paid for PokeVest subscriptions (through any platform) in the 12 months before the claim, or $50, whichever is greater.

No Warranty

The app is provided “as is” and “as available.” We make no guarantees about the accuracy, reliability, or availability of the app or any of its features, including premium features. Use it at your own risk. Premium features may be temporarily unavailable due to maintenance, software updates, bugs, or circumstances beyond our control. Temporary service interruptions generally do not entitle users to refunds, credits, or subscription extensions, except where required by applicable law or platform policy. We are not liable for losses arising from service interruptions except as required by applicable law.

Data Retention & Deletion

For details on how we handle data retention and deletion timelines, see our Privacy Policy. Some data may be retained for legal, compliance, or operational purposes (e.g., to prevent fraud or resolve disputes).

Tax & Legal Disclaimer

PokeVest is not a financial, legal, or tax advisory service. All data and summaries provided by the app are for informational purposes only and should not be relied upon for financial decisions. Please consult a qualified advisor for legal or tax-related matters.

Changes to Terms

We may update these Terms from time to time. If we make significant changes, we'll let you know through the app or by email. By continuing to use PokeVest, you accept the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or similar corporate transaction.

Entire Agreement

These Terms, together with the Privacy Policy and any applicable platform terms from Apple or Google, constitute the entire agreement between you and Southern Islands Trading Card Company LLC regarding the use of the service.

Survival

Any provisions of these Terms that by their nature should survive termination will remain in effect after termination, including provisions relating to intellectual property, limitations of liability, indemnification, dispute resolution, and payment obligations.

Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws principles.

Dispute Resolution

If you have a concern or dispute about the service, please first contact us at legal@southernislands.llc so we can try to resolve it informally. If we cannot resolve the dispute within 30 days, either party may bring the claim in the state or federal courts located in New Jersey, USA. To the extent permitted by applicable law, you and Southern Islands Trading Card Company LLC consent to the personal jurisdiction and exclusive venue of those courts.
